Fonts are often used in products, websites, apps, and content that are distributed internationally. This means a single use of a typeface or font software may be subject to multiple legal regimes at once. Assumptions based on one country’s laws may not apply elsewhere.

Yes. While the U.S. recognizes copyright protection for font software, it generally does not recognize copyright protection for typeface design itself. Many other jurisdictions do recognize typeface design as a protected creative work if originality requirements are met.

In some regions, including the European Union, typeface design may qualify for both design protection and copyright protection. Recent EU legislation and case law confirm that design protection does not exclude copyright protection if the work meets copyright requirements.

Courts assess whether a typeface design or font software reflects the author’s own intellectual creation and free creative choices. Technical constraints alone do not prevent originality. Elements such as outlines, spacing, kerning, and OpenType features may contribute to the creative expression of a typeface.

Even in jurisdictions where typeface design is not protected, font software often is. Licensing provides clarity, supports designers and foundries, and helps businesses avoid disruption when operating across multiple markets.
